Extension of Stay - to complete 1 year threshhold as common law partner

Hello,

PA is here in Canada last Sept 30 2021 with IRCC approval on Family Reunification - extended family member of a Canadian Citizen.

We are completing the 1- year threshhold for common-law partner and intend to apply for sponsorship once we meet the 1 year requirement and the required documents to be attached.

Here are our questions on the application for extension of stay:

1. Can we check that PA is staying for more than 6 months? If yes, does it require a medical exam?

2. Do we need a letter of explanation that we are completing the one year threshhold for common law partner. PA is separated to spouse since 2017.

We sincerely appreciate all the help you can give us. We really need it. Thank you for all the assistance you can extend us.

1. You can try asking for 1 year. I don't know about the medical.
2. Yes, you should definitely include a letter to specifically state that you are requesting the extension so that you can complete 1 year of cohabitation to become common law and the submit the sponsorship application. Based on experiences on this forum, if this is the reason given, the chances of the extension being refused are very very low. Also include proof of funds, etc.

Hi Scylla,

Thank you very much on your reply. On PAs previous marriage. There is a question on the form on status of previous marriage. Should we write separated or legally separated since PA was abandoned in 2017. Just want to confirm if right.
