Extension application help

Hi All,

So after exhausting all of my options looks like my time in beautiful BC is coming to an end, Ive been waiting in the PR draw for months on 465 and no ITA, applied for WHV again - refused which was expected, asked work to do Young Professionals Visa for me but they cant cause I am on contract and not permanent. Short of marrying a Canadian in the next 20 days (when my visa expires) I am out of options.

So to buy myself some time I am going to apply for an extension - has anyone done this before I just want to know if I have to fill out all of these forms even if they dont apply (ie the common law union form and Use of representative form)

Any tips or hints would be greatly appreciated as I read on the cic website that if you send in an application and its incomplete or incorrect it is deemed that you never sent in a valid application and your implied status in invalid.

I should probably say I am applying for an extension on the grounds that my current job contract is until Feb 1st and I didnt work for 4 months at the start of my visa in Canada - supposedly this matters?

Are you trying to extend your WHV? If so, you can't do that and I wouldn't recommend you try. The fact you didn't work for your first four months in Canada isn't grounds for an extension.

These days when you apply for a work permit extension and don't qualify for it, CIC is rejecting (rather than refusing) the application which means you are out of status in Canada the day on which your WHV expired, you're not covered by implied status and any work done since the expiry of your WHV is classified as illegal work.

I suspect CIC has put in the above process since the are tired of people sending extension applications when they clearly don't qualify. I would recommend you not play games with the system. You know you don't qualify for an extension. If you want to stay in Canada longer, change your status to visitor and stop working when your WHV expires - or get your employer to secure an LMIA so that you can apply for a closed work permit.

There is no "proper" way to submit your application since you don't qualify for an extension.
