Expression of interest "Spouse Exclusion"

Hi,

I am currently in Canada on Post Graduate Work Permit valid till Feb 2017. My spouse is coming to Canada in March 2016 on Dependent Visa (Work Permit) based on mine. End of Feb 2016 I am going to have one year Canadian work experience (Skilled Level B). I am planning to submit my Expression of Interest in April 2016 to CIC. However, My wife has not completed her degree yet and does not have any work experience. She also has not given IELTS. Therefore, I am going to loose point significantly if I include my spouse to the expression of interest.

In this circumstances, will I be able to exclude my spouse from my Expression Of Interest even though she will be already in Canada on Dependent Visa and I will mention my marital status as Married?

Yes. Do remember that only you will get PR if your spouse is listed as 'not accompanying'. They will have to either immigrate on their own to Canada or you can sponsor them under Family class at a later date - that takes much longer than EE.

Some people are saying if the wife is not included as an accompanying applicant, it will be misrepresentation of information though it doesn't make sense to me. Just for peace of mind, do you have any references to support your statement? If so, can you kindly share those with us.

There is a difference between stating in your profile that you are not married when in fact you are (that's misrepresentation) and selecting you are married, but your spouse is not included in the application.

The latter is not misrepresentation, because that is an explicit choice you are given when creating your profile. If that was an invalid choice, it would not even be included in the questionnaire.

just so you know it took 29 months for my buddy to bring his wife on spouse sponsorship so be prepared for that .

That was my point but someone people are too confident to label it as misrepresentation. Anyway thanks for the reply.
