Express entry ITA for two years - 6 months in India

Hi Friends,

I moved to CA on Mar-2021, and completed my Celpip and in Feb'2023, Got my ITA as well.

However, in these two years, I was in India for about 6 months but still employed in Canada payroll and getting pay cheque.

Is it ok to proceed with submitting PR application or I have to be exactly in Canada for two years, anyone faced the same situation?

The six months you were in India need to be claimed as foreign work experience and not Canadian work experience. As long as you've claimed those 6 months as foreign work experience, you are good to go.

In Jan 2023 my score was only 482 and in Feb2023, it got changed to 495 by considering the completion of 2 years.
So, if I exclude 6 months from CEC, it will be just 1.6 years in Canada and my CRS will stay at 482 alone right?
In that case I cannot proceed with ITA right? Even though system considered as 2 years and issued ITA.

The issue is that you should have listed the six months outside of Canada separately vs. combining this with your work experience from inside of Canada. The work experience listed in your EE profile is incorrect. That's why the 2 years was calculated. Technically you only have 1.5 years in Canada which would reduce your EE score. If your corrected EE score is below the draw cut off, then you should really decline ITA.

Of course you can chose to go ahead with the application. However you're certainly at risk of refusal since six of the months you've claimed as Canadian work experience are not.

Safest / right choice is to decline ITA and fix your profile to show the six months as work experience outside of Canada.

Correct. You need to be physically in Canada for it to count per IRCC's rules.

Only some fees will be returned. Not all of them. Some of the fees will be lost.

I'm not sure I understand your second question. The end result of any application is either an approval or refusal.
