I filed a family class application for PR w/ my Canadian wife as sponsor. I entered as a visitor and filed an inland application. My 6 month status has expired. I was advised to file for restoration within 90 days. Can I request to stay for the entire time it is expected to take to process my application? Currently that's about 21 more months!

Usually they won't give more than one year and then you have to ask for another extension. I think you can ask for more but I've never tried asking for more. I think that if you ask for more than a year they will just give you one year. Even if it says 21 months, that's for 80% of applications. Many applications take less time than that.

when did you apply Inland? My husband is in a similar situation, we applied for an extension visa in Nov, visa expired in Dec, have not heard back from anyone yet. We applied inland in Jan, sending proof that we applied for the extension visa.
I was told he has implied status until he hears back from CIC. His 3 months to apply for restoration is up in March,so we should be applying for the restoration visa by Feb 17 a month before his 3 months is up.
Does anyone have any advice for us? Thanks

If u have already applied for visitor extension in Nov, you don't have to apply for restoration again. Just wait till u hear from cic.
Just keep extending ur status or once u get OWP, I guess you don't have to request visitor extension.

thank you for that, I'm just worried if the extension gets denied then he will fall out of status then he may not be eligible for the pilot program.
Do you have 90 days to apply for the restoration visa from the day his visa expired, or from the day he gets denied (if he gets denied), i'm just paranoid.

thanks

Up to the time that you get an answer on the extension, you are still in status under "implied status." If he gets denied, he needs to leave the country as soon as possible, but I think that means within 30 days at the most.

Ok thanks, just wanted some clarification. I am hoping to here back in regards to the inland application and that way he would have status all together. Its just so frustrating waiting to hear back from CIC.

What do you mean by that? Are you aware that an Inland application (alone) does absolutely nothing to extend, or restore a person's status?

i mean he should then get his OWP (it was sent along with the inland app).
