Hi every one,

My status is expired on July 17,2016. Before my expiry i filed paper application for extension which got refused on Nov 1,2016. In the mean while during my implied status it happened to be i received invitation to apply (Sep21,2016). I filled my application, transmitted on Nov 3, 2016 which is today. Whats next? should i apply for BOWP? or should wait for eligibility confirmation? i got ITA based on CEC.Please help.
 
You're out of status in Canada now. So a BOWP is definitely out. Hopefully you have stopped working. You would need to apply to restore your status in Canada before you can qualify for a BOWP. It can take some time for restoration applications to be processed.

Did your letter say that you were refused or rejected? Did it specifically mention as of when you were out of status in Canada?

Because your work permit has expired, you are no longer eligible for the BOWP. It is not possible to "restore" to a BOWP.

Your only option (if you cannot get a new work permit through other streams, like with an LMIA) is to apply to restore status + change to a visitor. You won't be able to work, though.

What country are you from? Have you looked at IEC programs?

Letter says
"We also wish to advise you that your temporary resident status expired on November 1, 2016.

You may apply for restoration if, within 90 days from the expiry of your temporary resident

status, you submit:

 a completed application form;

 applicable fees for restoration and for the immigration document(s). Payments should

be made online at www.cic.gc.ca. When you are finished, you must print the receipt ofapplicable fees for restoration and for the immigration document(s). Payments should

I am from India. At this point even if my eligibility gets accepted, do i have a chance to apply BOWP using APR


"If the paper APR under one of the qualifying economic classes was submitted by mail prior to January 1, 2015, or was submitted outside of the Express Entry system, it must have a positive eligibility assessment in order for the foreign national to be eligible for a BOWP.

The positive eligibility assessment is considered to be made once the status of the Eligibility field in GCMS is set to “Passed” (or “Met” for FSWC applications submitted prior to January 1, 2015) or an Acknowledgment of Receipt letter or email has been sent to the applicant.

Applicants applying for a BOWP must include a copy of their Acknowledgment of Receipt letter with their open work permit application."

An application for restoration has to accompany another valid application for temporary residence status. Based on the info provided, you are not eligible for a new work permit, so you cannot "restore" status as a worker. You could restore status as a visitor (if you meet the requirements).

No. As previously stated, you must have a valid work permit at the time you apply for the BOWP. You do not have this. I have provided you with the link for the rules.
