Expired pr card and returning to canada

Hi all,
Here i am seeking some
kind of adivice from you who know well about the matter. I am a bangladeshi national holding expire pr card of canada. I am out of canada for more than 5 years. RO have not been met. Now i am highly despeately want to return to canada. I know the consequences regarding when entering the land boarder of USA. MY QUESTION is that for entering canada through usa is transit visa ok and without valid pr card availing usa transit visa could be possible or not.

You are still likely to be reported. Given such a long absence from Canada it will be very difficult to retain your PR status. How long have you been out of Canada and how much time have you spent in Canada? What was he reason you were unable to live in Canada?

You will need to obtain a U.S. visitor visa (B2) - not a transit visa.

If the flight destination is ultimately Canada, regardless of where you transit, you’ll need a valid PR card or a PRTD.

Yes. Most probably. You can try for a transit visa but don't be surprised if it's denied.

Your problem is that you don't hold a VALID PR card to guarantee entry to Canada. Therefore the USA may consider that you can't demonstrate onward travel. Also, your onward travel is not via a commercial carrier.

Transit visas is for ongoing flight travel. It allows you to land in the country before taking your next flight. You need a B2. When you arrive at the Canadian border without a valid PR card you will likely be reported unlesa you have a reason why there is no way you could have returned. There aren't many reasons to justify such a long absence.

You'll need a B2.

Years ago when I worked at the airport and dealt with flights heading too the states inbound and outbound, there used to be the TWOV program. This was for passengers not holding an American visa the ability to transit between flights to take them out of the USA. I remember vaguely it was cancelled for two reasons
1- 9/11
2- Too many people transiting the USA without a visa escorted by security, would make a mad run for it away from the guards and disappear into the crowds .
The program was causing FAR too many headaches for the government and the airlines , since if a airline lost a TWOV passenger, the fines were HUGE, not your regular they have no visa fine, but you lost a person fine
Everyone breathed a sigh of relief when it was axed

Not answering from experience but If there is a CBSA office in Fortune I guess will operate same as any other CBSA border checkpoint although seems an odd route to take and if you are assuming might be easier through there with an expired card I would speculate maybe not given the volume of people passing through is likely a lot less than a normal entry point.

Note the seasonal hours which assume tie in with any ferry operation. Not sure how you plan to get to Saint pierre and Miquelon in first instance but guess you have worked that out given apart by air from Paris in the summer I could only see by ferry or air from Canada.

Maybe check if you need a visa to enter Saint pierre and Miquelon given the French status as that does not seem clear based on passport. A Schengen visa for example is it seems of no use despite the French status

So assume then you will be travelling via Paris in the summer to get to Saint pierre and Miquelon as seems the only route apart from through Canada. Assume you have validated whether you need a visa to transit Paris and although I have no inside info seems a long shot as a Bangladeshi to provide a visa purpose of visit to Saint pierre and Miquelon , a 93sq mile territory, all the way from Bangladesh.

If it all works then good luck to you but seems a long shot and arrival through that route seems likely to get more scrutiny at each stage of travel rather than less.

Your plan should work in theory, but I doubt many people have first-hand experience with this route given that direct flights from Paris have only made this a viable option since 2018.

A few things to consider:

  • You will need a visa to visit France and this territory. Why was your US Visa declined, and would the same rationale likely lead to refusal for a French Visa?
  • You most likely won’t be able to use the ferry (as you seem to acknowledge), so you will need to find a private boat and someone to pilot it. If I was a local, I would probably not give a foreigner with an expired PR card a lift. This may be a bigger challenge than you realise.
  • If you do find someone to ferry you across, I would expect extra scrutiny by the border officer that processes you. This person will likely have to come out to the harbour where you arrive specifically for your boat. Highly unusual for a Bangladeshi national with an expired PR card to take this route.
So in the end it is up to you. It’s a pretty expensive undertaking with a highly uncertain outcome.

You can't, even if you are still a PR of Canada (you don't automatically lose your PR status) you will 100% not be allowed in with an expired PR card. You'd need a PR travel document which you are not eligible to get.

So you will not be allowed to enter to Canada ever again.

Your options:
  1. Apply to have your case reviewed and wait for a decision. But of course unless you can justify it, it's almost certain there is no way this will work and most likely take a very long time, even years.
  2. Voluntarily renounce your PR status and reapply for PR through Express Entry or any other way.
Sorry, but that's the harsh reality.
You shouldn't consider yourself a PR anymore, actually since 5 years ago.
