My husband been here for 2 years he has a ETA its good till 2019 i will be fully marriage spouse sponsoring him next year but if his Eta runs out can he still apply. For his eta even though he is out of status.

The validity of the ETA is irrelevant to his status in Canada. He was supposed to have been extending his visitor status, but you make it sound like he hasn’t at all.

Agreed with the above. The validity of the ETA has nothing to do with how long he was allowed into Canada. Has he been extending his visitor status every since months?

our lawyer said since he cant extsend his stay anymore bc he hasnt made folllow ups to extend but she can still apply for documents

Your answer doesn't make sense. Has he been extending his status? Does he currently have valid status?

He is out of status now and are lawyer said since he didnt exstend his stay bc he forgot he wont be able to exstend it and she said if his eta runs out he had to apply again but since he is out of status can he still apply for a eta

Get rid of the lawyer. As stated previously, the eTA is irrelevant to status in Canada. When did his status expire?
 
Now that we have all the facts, to answer the original question of whether he can apply for an ETA: it will more likely be rejected because he was out of status in Canada for a considerable amount of time. He is also at risk of being denied entry if he leaves and attempts to enter on his current ETA.

That lawyer is giving unsound advice, probably to make you more reliant on them. Immigration rules tend to be pretty straightforward until you put yourself in trouble.

Say if i sponsor him and he is out of status in canada can he still stay

Why are you waiting to sponsor him? Legal status is not a requirement to sponsor.
