Hi guys!
My partner is from Australia and has applied for an eTA about a week ago. M He clicked yes on the question if he had been charged with anything. He went to Court a few years ago for drug single possession but was never charged with anything but still was asked to send Court documents and Police check. He’s still waiting on his police check to come through, but I was wondering how long it usually takes immigration to approve an eTA once the documents have been submitted and they’re all clear.
He’s meant to board a flight today but I don’t think this will happen. Thank you!!!!

If your partner was not actually charged, you should have clicked no really. By clicking yes you have put more scrutiny on his file, so I doubt it will take just a week.

Yes I thought so too. We’re just wondering if it’s more likely to take a week or 6 months to get an answer!

Are you sure he wasn't charged with anything if he went to court? I take it you mean he wasn't convicted, but in most judicial systems similar to the UK system, you don't go to court if you haven't been charged.

He may not have been convicted, but the question on the eTA is "Have you ever committed, been arrested for, charged with, or convicted of a crime" - and if he'd committed the crime and been arrested for it, even if he wasn't charged, he has to answer yes. If he went to court, he was most likely charged, but if he hasn't received a punishment, he hasn't been convicted. A background check would show up an arrest, charge, or conviction - so it's better not to lie.
