I have a friend who has a recent DUI conviction. They would like to apply for a TRP in the near future.
Before they were convicted they applied for an ETA and checked they did not have a conviction on the ETA application online. Although,they had been charged and arrested. Since they struggle with dyslexia they did not read the question correctly.

They are thinking of withdrawing the ETA and/or reapplying by answering the question correctly.

Will this hinder their TRP from getting approved? They did not travel on this ETA.

They should withdraw the ETA application if it hasn't been processed yet.

If the ETA has already been processed, then they should not travel on the ETA since they misrepresented themselves in the application and the misrepresentation is serious.

When they apply for the TRP, they may want to mention that they answered the questions in the ETA application incorrectly but that they did not travel on the ETA. Note that TRP processing times are generally very long right now. I would recommend they submit the application asap. They will need to have very strong reasons for wanting to travel to Canada given they are currently inadmissible.

They don't have a strong enough reason. They want to visit their girlfriend who lives in Canada. The ETA has been approved and they are going to cancel/withdraw it and just wait for the 5 years to be over then apply for criminal rehabilitation.

I have also been told if they don't travel on the approved ETA it will typically not be a concern. I'm sure there are many who make mistakes on the ETA applications.

I think you're probably fine if the ETA was never used.

TRP processing times are generally at least several months but recently most have been taking over a year to process.

IMO the girlfriend needs to plan to visit him.

Note that you can only start counting the five years from the time he completes any penalties involved with the conviction (inclusing any license suspensions). Once the five years passes, he can then apply for rehabilitation.
 
So basically it will be 6 years from the day he was convicted which was October 6th 2022.

I don't know. I don't know what penalties he was given. He needs to start counting the five years from the date he completes all penalties. So if his license is suspended for 1 year from his conviction date, then he won't be able to apply for rehabilitation until October 2028.
