Hi Everyone

I am having a situation and here are the details.

I was working in a company for more than 30 hours weekly on my study permit from last Oct 2016 and by god's grace got my PGWP in june 2017 and unfortunately my company got closed due to no work in August 2017. As i worked for more than 900 hours and i am eligible to apply for my EI benefits, i did apply for my Unemployment and i am still waiting for the decision.

My doubt is whether they gonna realise that i worked more than 30 hours on my study permit and will they make that as a problem now?

Please anyone who have idea regarding this can suggest me what to do. Thanks

well working 30 hours weekly on a study permit for sure was illegal work so would think will now be a problem both claiming anything and even maybe keeping your PGWP if the authorities find out. You can only hope they do not look with any detail into the hours you are claiming to have worked that from Oct 2016 you were working 10 hours extra a week illegally and then also you applied after that for a PGWP.

I would personally withdraw the EI claim since you worked illegally. Submitting the EI claim draws attention to the illegal work and could potentially compromise your status in Canada.

Oh really?

OMG i am scared now

Not sure why this would be a surprise. You worked illegally and violated the terms of your stay in Canada.

So in that case working for 21 hours is also illegal and most of them do atleast 21 hours weekly but there is no news of that ?

so u mean it will be a problem for my status?

The regulation states that full time students can work upto 20 hours a week but in your case, you were working 30 hours a week. In conclusion, you were working full time hours instead of part time. So in the future if you plan to apply for PR at some point, you must declare this otherwise you'll be charged with misrepresentation and get a 5 year ban from entering Canada.

So your status now can be questioned at any time in which CIC decides to do an audit and finds out that you worked more than you were allowed to do so.

Anything above 20 hours is illegal.

Did you seriously think that working illegally would not be a problem? Did you plan on eventually applying for PR and committing further immigration fraud by lying about your work history?

Yes i know its illegal but it all happen due to my stupidity. So in that case if i get my citizenship and later they come to know that i worked more than 20 hours weekly on my study permit will they revoke my citizenship?

If you don't declare that you've worked illegally, even after citizenship CIC has the right to revoke your status.

Oh okay. Thanks everyone for your response's

Will it helps me if i go to any lawyer in that situation? coz i believe they already made a decision on my application as it has been 20 days i have applied for my EI benefits and no answer from them. I am really tensed and worried :(

Well the damage has been done since you already got your PGWP. Unless CIC does come after you, then you might seek legal advice then. Remember to declare this illegal work for future applications.

Okay!!!

Regarding the declaration everyone saying, how to declare and where to declare about this? I mean there is no section in PR application to mention these kind of things so where exactly u want me to mention in future? Thanks

Hello, was you able to receive the EI? Did CIC had any questions? I am in completely the same situation now. Please advise
