On my previous post, I stated my employer terminated me in June with some " made up" reasons. I already gained my " one year CEC qualified" work experience from this company. However they are refusing to issue a " fair reference letter" insisting to put I was terminated with cause. I am now officially in labour dispute with them. I have a statement from the company for other purpose dated in May 2013 (with all my job description and pay). and also I have all my pay stubs with me. what can I do? thanks for your inputs guys

Are there any other means with this issue? Can a co-worker testify or make a reference and make an affidavit about the reference letter?

I don't think any one would risk their job to testify. However, I have a statement from the company back in May with all my job details. there is a one month gap between the date on that statement to the date i was terminated. I think I should also write a letter to the CIC officer to explain the situation.
 
AUnfortunately, this could be a problem. Assuming that the one month gap is the difference between completing one year of employment, you should apply for and submit a copy of your Record of Employment (ROE), if you haven't done so already (you would need this for your Labour claim anyway). That will show an official end date. The problem is, the VO could say that the evidence is insufficient to demonstrate that you actually performed those duties for the whole year.

Focus on getting that new LMO/employer...
 
For the purposes of applying for CEC, there is no need for them to mention that you were terminated. Give them the CEC checklist so they know what's required. Also, would it matter to CIC that you were terminated IF you in fact did the duties and responsibilities associated with your role? I don't see why or how it matters.

Did you already have one year of work experience by the date of that experience letter?

As jes_ON suggested, apply for your ROE, submit your paystubs(you can submit the ones for the period not covered by the letter you currently have), any other documents you have that indicates you performed those duties. It would be a good idea to write a cover letter to explain why you are not able to submit a current employment letter, etc.

Where you are in litigation with them, they are probably(on advisement of their lawyers) not going to communicate in any way, shape or form with you. If you win your case or reach a settlement, perhaps you can consider asking for this employment letter as part of the deal and also for someone(who is not directly involved in the case) to provide their contact information in case CIC calls to verify your employment details and the person should be required to provide true and factual information and do so in good faith. Since you will need a reference for future job applications, also consider adding this as part of your deal.

Hi terki,

Regarding your friend, are you saying that he/she did not submit an experience letter at all? Was the intent of the cover letter to explain the reason for not submitting that letter?

write an explaination letter about this non coperation from your employer , attach it along with ur CEC package , submit all other proofs like Pasyslips , any prveious letters , NOA, workeprmit copies both original and the extended , get a letter from your reporting client if possible with duties , hours , and role , it should help

While this sometimes works, in most instances it doesn't. So while their is always hope - you shouldn't be overly confident that this solution will work for you.

Explanation stated I was in a labour dispute with the company and they refused to issue any letter. all emails between me and a Ontario Labour Board officer to prove that i was actually in a dispute. Also my pay stubs in June to cover that one month gap.
