I came in Canada with a 2 year work permit with LMIA exemption, have another 1.5 years left on it. I had applied for a spousal PR as my wife is Canadian. Now they asked me to send my passport to get the permanent residence visa sticker on it.

my question is, if I get the PR visa, will the work permit cancel by itself?

I am worried because my marriage is not going well and in case we get a divorce, what will be the status of the PR then? if the PR cancels out, then I wouldn't have the Work permit too then.

is it like that or does the work permit stays valid for these 2 years.

Now that I am invited to send in my passport to finalise the PR visa, can I ask them to change the category of PR from spousal sponsorship to regular PR for someone with a work permit?

thank you

The work permit and any TRV will be cancelled. You will have a landing visa. Once you have landed, it's unlikely you will loose your PR if your relationship breaks down. You should be fine unless your wife cancels the application (might be too late at this point) and condition 51 no longer exists.

For sure do not even consider yourself suggesting to IRCC any change from spousal to standard PR just get your landing completed as soon as you can and then you are set for your new life either married or single.

Thank you for your amazing answers.

I had another question, since I am in Canada, do i have to exit and enter to do the landing or can i go to service Canada offices to get it done?

thank you in advance

You can call and make an appointment and do the landing at the nearest office. They do tend to take some time, from what I have seen (2-3 weeks). Depending on how close the border is, you can always make a trip and flagpole if it's convienient. Make sure you have status in Canada when you land.

I did send my passport for the Visa sticker, and it was recieved in Ottawa yesterday morning. Then the status still said decision made. However in the evening the online application status said 'Withdrawn'.

I and my spouse didn't even have a real argument, but once her mother found out she was pregnant, she immediately called her back to Toronto in mid March, (I am working in NS), and now that they found out that I got the PR, as I forwarded the letter from immigration they stopped communicating. Her mum even announced our divorce among her family friends, while I and my spouse didnt even have a chance to talk about what was going on. My spouse has been working for last 12 years and has a joint bank account with her mum, and perhaps that is why the mother doesnt want to let go of the daughter.

1. Now I am worried if they will put any stamp on my passport,

I had included a prepaid priority post envelope as they wanted,
2. but how long will they take to send me back the passport?

3. Since it was withdrawn, I hope the work permit is not affected by it and stays valid?

4. can I get a refund, spend so much money applying for the PR?

5. can I reapply in a different category? is there a general category?

Thank you guys for the replies.
