Hi!

I am separated with my husband for 4yrs now and I haven't filed a divorce/separation yet. He is not interested to come to Canada. Can I just choose Legally separated and include a marriage certificate and a letter of declaration of separation? is it enough proof for my status? is it gonna delay or reject my application? I hope someone can answer my question with the same situation that had their PR done or those applicants that are going smoothly.

i was in the same boat as u but the different is that my separated spouse is a canadian citizen so i only provided marriage license with a written explanation. i never included any separation documents.
 
my friend got her PR status it took her more than the usual processing times because the CIC needs ur explanation and if u have kids they need your spouse signature for taking your kids with you and his signature that he wont be included in your application for permanent residency. And too much hassle too because you need to go back to your country for your spouse signature and you need to be present with a lawyer making the affidavit. goodluck :)

hi b.h.a.b.e.s, i am exact situation as ur friend. i have to travel back home to get my ex-spouse signature for my kids to accompany me to canada.. could this cause a delay for me?? could this be the reason why i haven't receive AOR and all my mates here have received theirs?? does including kids without the other parent cause delay in processing?? how long did it take ur friend to receive AOR and her PR?? I just need someone to talk to ::) ::). Thanx for sharing

seems like your case is quite complicated, therefore it could be the reason why it's being processed at a slower rate than the others.
 
Really? they will need my spouse signature? But he doesn't stay back home coz he work overseas too in another country. He is a seafarer. Is it okay to explain that so that they won't require his signature? I don't have kids and properties yet.

hi, I am in the same boat as you too, my lawyer just made me a letter of explanation and the husband doesnt need to sign. I submitted my PR application last June and got aor in august, it's a good thing too that we didn't have kids or property. I just hope that it wouldn't cause any future delays though.
 
Could you share the application content which you send to cic to get exempted from spouse signature. I am also in same boat.

I made an affidavit explaning what happened in our marriage and that I am planning to file for divorce in the near future, then I have it notarized by a lawyer.my representative got me tp sign a declaration form (which u can request from CPP Ottawa) stating that my soon to be ex-husband is not part of my family member and he will not be sponsored in the near future. Goodluck on your application.

Thanks for the information. I will apply with the explanation of my situation and also attached the court document where my divorce is going on. is that sufficient to apply my pr file or I need to get arrange the affidavit wording and then need to send that along with my application.

Could you let me know for the same. What should I will do to file my PR application
 
Can you let me know exactly what you did and how this turned out?? I am in almost the exact situation, and they have requested a divorce certificate, which I don't have, as I am only legally separated.

Where did you get the declaration that was mentioned?

Very curious to see what I should do.
