Material Status - Legally separated or Married? Help needed!

Hi guys,

I need your help!!

My husband and I are living separated since Jan, 2020. We haven't filed a divorce because we have to wait until a one-year separation. What should I put in material status? Legally separated or Married?

It is impossible to get his passport, police certificate, medical certificate and he won't sign a separation agreement with me.

What should I do!?

It sounds like you are separated, but not legally separated. If you are the PA in an economic PR application - you didn't mention what your husband and you living apart has to do with immigration - make him an unaccompanying dependent and document his refusal to cooperate.
