Hi I have got a chance in one of the universities in Canada for education .I don't want my husband to come with me as I want divorce from him. If I apply divorce in India right now , will it affect my study visa? I have two dependent children .I will apply visa at the end of April 2019 .

1. Your study permit depends on the study program you have been accepted to + whether or not it is a progression of your previous qualifications and/or your work experience + your financial situation, etc.

2. In terms of your ties to return to India, your dependent children (assuming they do not apply with you) will be family ties to return to.

3. Hope you are able to demonstrate other strong ties to India: Property/land ownership, for example.


On a practical note (and reading between the lines of your post):
1. It seems you are likely to have a contested divorce and not a divorce by mutual consent (unless your husband agrees to it).

2. Your divorce case would most likely include child support, child custody and maintenance issues. This also means your children cannot travel abroad or with you unless your husband gives his consent for it.

3. Lawyers cannot represent you as proxies in your divorce case, especially for a contested divorce.

4. You would need to attend court hearings on scheduled dates + court-ordered marital counselling to see if there's scope for reconciliation especially because you have children, etc.

5. In short, will you be able to handle the practical realities of a divorce case + the emotional trauma that a contested divorce case can cause.... while studying in Canada halfway across the world from India and without the support of your family?
