Job Offer........
Pre-Assessed..
My case is like this:

My agent use 2171 to apply work permit , but the support letter's job duties is 2283 .

Finally I get work permit on which the NOC is in scope of 2173.

Now I applied 2283

my english IELTS . 6.5 7 6.0 5.5

the similar case I searched currently is :

one case get explanation chance, 2 failed cases.

I think my case will be reject,

but the 2283 given by CIC website support guy after I emailed them, they insist my code 2283 , even I emphasis that my title is 2173 .

now I am very worry it .

any others can share experience in similar situation ?

If your duties and job description matches 2283, but your work permit is for 2173 and your title is also for 2173, it will depend on the VO's judgement. For 2173, your IELTS is not sufficient, but for 2283 it is. All I can recommend is to wait for CIC to get back to you on this. Most likely, and only in my opinion, you will be ok, since your duties match 2283.

I start hate this work permit, why it is so confusing not strict , but later , the VO assess them become very strict.

I read several cases failed, I am very worried,

I can't change my duties, it is 100% true and can only be agreed by my manager.

and the agent, never explain to me what's NOC , just pick one they familiar with.

more question:

is it possible I request to update my work permit job title ? if so , how to do it ?

if so , my current work experience will be still effective or not ?

To change title on closed WP, a fresh LMIA needs to be submitted by employer.

what's mean LMIA ? oh, my work permit is LMO-exempt , it is a intra company transfer , and the question is my previous work experience can be effective as 2283 or not ?

LMIA is Labor Market Impact Assessment. It's the new LMO...

That's NOC matching.. Only those in your area of expertise AND familiar with NOC codes will be able to help you...

I don't know if the title can be changed in this situation,

the match is 2283 even I query the CIC with mail .

but work permit is 2173 .

Again title doesn't matter nearly as much as duties. If your duties match 2283, then it's 2283...

Yes, the problem is I saw several cases failed because title doesn't match on work permit . just because the title.

becasue VO think they are working illegally.

you can search 2283 reject CEC in google, you can find several cases failed exactly in that way.

What probably happened was that the title in their WP prompted the VO to double-check their duties, to see if there is a match to their claimed NOC. So, yes, if you claim a new NOC and work title that doesn't match what's on your WP, the VO will probably look at your duties closely. But that alone will NOT cause a refusal. In the end if the duties match the claimed NOC you'll pass.

I hope so , but I really doubt it ,

check below email from other guy:

I submitted my application under CEC category on June 11, 2012 and got AOR in Nov. After almost 9 months, CIC emailed me yesterday about refusal of application.

It states: You have been authorized to work in Canada in as a Quality Assurance Analyst, NOC 2171, a Skill Level A occupation. You are not authorized to work as an Information systems testing technician, NOC 2283, a Skill Level B occupation.

I applied the application under NOC 2283, as it exactly matches my job duties and responsiblities. I provided the letter of reference from employer along with application. I thought duties and responsibilities should match NOC rather than just job title and Work Permit.

It seems, that initial work permit that was issued by CIC was categorized under NOC 2171(Comp Analysts and Consultants). And they might be matching the same with what is defined in application. However two of my colleagues applied under NOC 2283, and they got PR already (however, their WP was also issued with NOC 2171). It happened last year. Seems like my odd luck..

The duties and responsibilities are bit different between NOC 2171 and NOC 2283. And hence i believe they consider it as unauthorized work..

I need some advise from Seniors... What are my options ? I have already quitted this company and came back to India. Should I re-apply under CEC from India or within Canada with NOC 2171 and ask previous employer to issue me a service letter with duties and responsibilities that matches this code.

If I do that, won't CIC come back to me later and refuse my application again, because there will be a discrepancy in duties and responsibilities against last rejected application? Do we need to provide any letter along with the reason?

Please advise.

If you are worrying that much about refusal, give the CELPIP or IELTS and get scores for NOC A, and then you will be set either way..

Yes, I once think about this for a moment , the problem is the duties is really 2283 , I can't change it .

I even check the doc used to apply work permit, the duties is still 2283 .

I don't know why my work permit accepted when it apply as 2171 and finally give me a title of 2173.

I also find case rejected as they change from 2174 to 2171 .

If now I take the IELTs test, then the reject would be tomorrow year, then I have to update my work permit , or work another year for the correct duties. maybe it is 2171 in some officer, and it is 2173 in some of them . who knows,

after that , the IELTs result would have been expired.

omg, why My company ask an agent to do this, and he never explain what NOC . just use it in files.
