Please & Thanks for the help

Guide 5772 - Application to Sponsor Parents and Grandparents

Hi There I have been through this guide as its contents do not match with the document checklist that is provided in the guide
For eg. Guide 5772 says Schedule A declaration has to be filled by the applicant his/her spouse & dependent children whereas the document checklist states it has to be filled by every person in the family over and above the age of 18 years

which should I follow

Checklist and Guide said the same.
  • You, the principal applicant;
  • your dependent children aged 18 years or older (whether accompanying you to Canada or not)

Schedule A should be filled by the PA and any PA dependant 18 years or over. Family members refer to PA, Spouse, and their children......and not their brothers, sisters.

Submit the documents as requested by the Checklist.............the Guide is just to help you with filling the forms.

I have a brother who would be the son to my mother but he is not dependent on her nor is he accompanying her to Canada
so I should not include him right for the docs completion

If the PA has a child who meets the definition for a dependant......then the child should be included as an Accompanying or Non-accompanying dependant........

Age and level of dependency......

Find out if your child is a dependant

If you brother is less than 22 years or meets the Age and level of dependency but is not migrating with the PA to Canada as PR as at this time......PA should include your brother as the PA Non-accompanying dependant.

If you brother does not meet the Age and level of dependency......PA should not include your brother as a Dependant.....However, your brother must be listed in IMM5406 Additional Family Form.

A copy of Schedule A Form should be filled by the:
  • the principal applicant
  • PA spouse or common-law partner (whether accompanying you to Canada or not), and
  • PA dependent children aged 18 years or older (who meets Age and level of dependency whether accompanying you to Canada or not).
Please refer to the Guide for instructions..

Thanks,

I did check my brother cannot be a dependent in both scenarios as he is 35 years old and has a nuclear family and is not dependent financially physically and mentally on the principal applicant that is my mother I have included him in the Additional Family info

Regards,
