Do I need to present B4 form at landing or settling?

Hi,

I have a question regarding the B4 and B4A form for declaring my goods and goods to follow.

My Question: Do I have to present the B4 and B4A form at the time of landing or at the time I am finally moving to Canada to settle?

I am planning to land as a PR in December 2014 when we fly to Canada for Christmas. We will however return to Germany after two weeks since we have to work until end of January.

We will finally move to Canada at the end of February 2015.

As far as I understand the B4 form I will not have to present it in December but rather in February since in December I am not entering Canada with the intention of establishing, for the first time, a permanent residence for a period in excess of 12 months.

Is this correct or do I have to fill out the B4 and B4A form in December before I land as a PR?

Sorry for asking again but now I'm confused and I do not want to do anything 'illegal'. On the B4 form tariff item No. 9807.00.00 states:

"I hereby declare that I have read and qualify for the provisions of tariff item No. 9807.00.00 and that:
1. I am entering Canada with the intention of establishing, for the first time, a permanent residence for a period in excess of 12 months and I arrived in Canada on _____"

Wouldn't that mean that in December I would not qualify for the provisions of tariff item No. 9807.00.00 since I am not entering Canada with the intention of establishing my residence in the country?

For all intents and purposes, you better be intent on establishing residency when you land, or at least that's what you need to tell the CBSA officer.

There was recently another case on this site where an applicant with approved app and COPR in-hand tried landing as a PR and explained to CBSA officer he would be returning immediately to his home country to complete school/work, and the CBSA officer denied his PR on the spot so he has to now re-apply or appeal. Part of PR approval is to convince CIC you will establish residency in Canada once you get PR. While in reality you don't need to do this, the technical rule is that all PRs are expected to be residents of Canada as of their landing date. Most CBSA officers aren't so strict about this, but who knows what kind of officer will do your landing.

And items not listed on your B4 forms at time of landing, may not be eligible for tax-free import when you try moving several months later.

google it. that's how it's found usually. you use the same forms for "accompanying" and "goods to follow". you will need 1 form for accompanying and 1 for goods to follow. you are creating 2 separate lists. b4a is the supplemental form to use in case you run out of room on the b4, so if you don't need extra space, it's not needed.
