on september 2011 me and my husband got married but we have been living together from december 2009 and has one daughter. i send my application on october 5 2011. without our marriage certificate but i include letters with same address on it, the copy of our cohabitation agreement signed in front of our lawyer last february as a common law partner. is it gonna be a problem or delays in my papers. do i need to change my lastname in my passport in to my married name? is there any documents i need to submitt? please help me. Thanks
 
I would say the only thing they might question is why you would be applying under common law when you are married?

Aside from that there is no reason to change to your married name, I am waiting until I (hopefully!!) get pr and then i'll change my passport and apply for a new pr card in my new name.

The PR card has to match the name on the passport / application, I wouldn't even worry about it til itts all gone through.

Changing the name by adding husbands surname will not give any weight for the processing the sponsorship and immigration papers. Any additional proof of your relation can be submitted if available.
 
I too wonder why you are applying as common law when you're married? I agree that if anything, this is what might stand out to CIC.

As for changing your name on your passport, if your maiden name is on all your other documentation, changing only your passport just gives cause to look twice at your application. The process is complicated enough as it is...i wouldn't add to it by introducing another name.

Are you going to forward them a copy of an update on your marrital status? I'm assuming you had your papers done before you were married and that is why you didn't file as married...?

I am sponsoring my husband and we sent all the papers after I changed my name to his... all except the passport because it costs money and time to change it before the expired date. So I left that in my maiden name until it's time to renew.
