Hi, I'm a US citizen who married to a Canadian and am living with her in Canada. When I crossed the border I was given no stamp or visitor visa coming from the US, which means I had 6 months in Canda as visitor.

My question is this: We applied for immigration (within Canda) prior to my 6 months expiring. For some reason I thought once I applied an extension of visitor status wasn't required while application of PR was in-progress. But now I'm not certain if this is the case. I've not been able to locate an exact answer to this.

Thank you so much for any help!

Did you include an open work permit with your application?

Too bad you didn't apply outland... When did you submit your application?

Hi Nick, did you apply for an Open Work Permit too? If so, then you are under what is known as 'implied status' until they decide if they will grant the OWP. Otherwise the PR application does not give you any status until completed (or at very least AIP).

No, I didn't apply for an open work permit. I don't intent to find a Canadian job, plus when I first consulted with an immigration lawyer she had said that a work permit is now automatically issued 4 months after applying. Maybe she meant only if I apply with the application?

Thanks for your help. Looks like I'll need to apply for a visitor visa extension.

It is granted in 4mos if you apply for it. They are good for two years.

Thanks for everyone's help. I do have one more question...

I'm applying to extend my stay with form IMM 5708. Under "Details of Visit to Canada" question 2, it asks "Indicate how long you plan to say". I plan to stay permanently.. so unsure how to answer this. I'm filling the form out in acrobat and it requires a date to be entered. I believe I have to extend yearly, so was thinking have it a year from today?

Thank you!
