You would be require to provide proof that you are legally able to marry. You cannot get a marriage licence without any proofs that you can legally marry. You have no choice but to provide divorce papers. You only need to provide the proofs to the provincial governments not federal as marriages falls under provincial jurisdiction.

If you get a divorce other than in Canada the government also requires a search done by a Canadian lawyer to make sure it is legit. My husband got divorced in the U.K and when we married in Ontario had to summit this to the marriage licence office to be approved before they would issue us a marriage certificate. It cost us $300.00 for the lawyer . This may not be required in all provinces but we didn't find out until i called the registrar office to set up a wedding date.

I am surprised that the local office even let you get a marriage licence without asking for proof of it. I had to provide proof that my wife was able to marry me. Lucky for me, my then fiance was able to provide the documents needed despite her being in another country. She mailed me all the documents I needed prior to applying for marriage licence. They took photocopies of her documents and then gave me the licence.

Screech when he came over on holiday we went to the registrar office and gave them the documents and set up a date, then i had a phone call saying i had to get it cleared from the Ontario government that his divorce was legit from Canadian standards. We didn't get our licence until 2 days before we was planning on getting married.
