Hi All

My sister (age 27) is physically disabled and is dependent on my mom. I am planning on sponsoring my mom in future. Can my sister come with her?

Is there any way to bring my sis here. She is suffering from polio, however she doesn't have regular medical needs.

If my sis is included in application, is there a risk for refusal to my mom?

Can i make an appeal under H&C? Is that being done after the application is refused or before making the application.

Please advise

Hi

Your sister can be included as a Type 2 dependent in your mother's application. Provided her disability will not cause Excessive Demand on Canadian healthcare/social services, there should be no issue. If it's determined that she would cause Excessive Demand and you cannot prove otherwise, then the entire app, including your mother, would be refused.

Only way to know for sure is to submit an app and see what happens.

Yes it will. But then would your mom really want to immigrate to Canada permanently if your sister is unable to come?

It all depends on her disability. If she requires any particular medical treatment or special equipment or adaptions, research how much it costs here in Canada.

CIC doesn't just outright refuse an app for Excessive Demand. They will issue a procedural fairness letter. This gives you the opportunity to show a mitigation plan, that her disability will not cause Excessive Demand.

Well if you're saying that she has polio, but "no regular medical needs", then it shouldn't be difficult at all to show CIC that her disability won't become an excessive demand.

Assuming that they (and the OP) do, you will require three years of Canadian income meeting the LICO requirements (that's Low Income Cut Off requirements). Income from 2016, 2017 and 2018 if sufficient will allow you to apply at the beginning of January, 2020.

Not necessarily. That's only true if the OP applied outside of Canada. There are many people who go through the FSW program who are already living and working in Canada - and already have several years of Canadian income that meets LICO before landing.

How to prove that it wont cause excessive demand? I mean, is there a requirement of letter form doctor? The only need of my sister would be a wheel chair....and physio therapy... from what i know..physio therapy is not funded by govt

You can include a letter from her doctor in the application explaining the specifics of her condition and that she doesn't require any medication/treatment that will cost Canada.
