We just sent off our spousal PR application and turns out even with th fastest courier it won't get there until sometime Wednesday next week. I run out of status by Monday midnight - there's nothing beyond our control we can do, so is the best just to call Vegreville and explain its been sent and so on? Or is it just tragic and means that I am overstaying by a day or so?

Please help
 
If the file arrives after your status runs out, then I think that means you are now out of status (not just or a day or so - but out of status at least until you get first stage approval). I don't think there's any point in calling Vegreville. It won't change anything.
 
Will this mean that it may be refused for that reason? Or would you say my best option is to try and do a flagpole?

It don't make sense because what we thought was that I'd automatically get implied status until a decision is made for my OWP (change of status from worker to visitor) oh this is majorly confusing. We have filled in an online extension of my stay as a visitor and I'm assuming that once we send that off say today and they get it on Monday that means I'm good to go?
 
You are from the U.S. right? visa-exempt? I would do a 'flag-pole' with my receipt of payment for the PR application in hand.
 
I'm from Denmark still visa excerpt. We have filled out an online extension of my stay. My international xperience Canada visa runs out on Monday so if they receive that on Monday do you think that would work? We live pretty far from the border but if we absolutely have to then well do it. If we include a letter of explanation, a copy if receipt (which we decided only to pay the $550) fee and pay the other fee later on - wouldn't that be good enough?
 
Well rather than a "yes" I'll say you "should be", and I would take that gamble (unless someone here strongly recommends otherwise from personal experience). But if you get a letter from CIC asking you to leave, then do so (go and do your flag-pole at that time).
 
So dilemma is that puralator the postal company doesn't deliver it until Wednesday sometime. My work visa runs out Monday. Along with my inland PR we included an OWP (change of status I guess?) so when they receive it on Wednesday I am on implied status?

I have just sent an online application for extending my stay which we explained the situation and included a copy of the receipt payments for both parts of the PR application and the OWP so I guess I'll be on implied status until ANY of these three things we applied for are either accepted or denied even if they don't receive it until Wednesday and with my visa expiring on Monday?

It's all a huge labyrinth our minds Are running a thousand miles per hour trying to figure if we did this the right or wrong way. But going to the states to do a flagpole would be the absolute last minute decision to do sine we live quite far away...
 
No, as alluded to by 'scylla' you are not on 'implied status' until you have an eligible sponsor, and that doesn't happen until your sponsor is "approved" (Stage 1 approval).
 
Wouldn't I get implied status because of the of the status change to an open work permit? I understand the PR application won't get me implied status but I've been told including an open work permit with PR application will grant me the implied status.
 
True, but that doesn't happen until Stage 1 approval, hence the reason you don't get OWP until after Stage 1.

What if I extended my stay right now online, explain that my visa runs out on Monday and include a copy of the receipts for what we paid for the PR and OWP? There's not much else we really can do at this point!!
 
As I previously posted... personally "yes" I would take that gamble and go with that.
 
Pretty sure if you send off an application to change the condition of your visa you are on implied status. What is the point of being given implied status after stage 1 when they give you the work permit either way.

Ill be in a similar situation in a month but I'm just going to the border to change my iec to a visitor.

1. You say you have filed for a visitor extension online. When filing an extension online you should get an immediate acknowledgement that it has been accepted. If this is true, since you filed it before your current status expired, you will be on implied status until a decision is made on the visitor extension.

2. You have filed a PR application with an OWP application so hopefully you will get your visitor extension, then first stage approval and an open work permit.

Since you are filing the OWP after your current status expires it does not give you implied status, only your visitor extension app does.
