Dilemma situation - Stay or Leave?

Guys,

I got a very unique case. Hope anybody can help. My friend from India applied for XXXXXX clg in BC for May Intake.

Approved and got visa stamped until 2020. Came to Canada in May. Didn't felt better.(call it homesickness or the place he was living at but he didn't wanted to saty there at all).

Left BC and started living in Toronto just after attending the first semester(tbh that wasn't a semester - his clg was to officially start in Sep - basically he just attended few classes) in hope that he might get another clg in Toronto.

Came to Toronto in Sep. Haven't got any offer letter from any clg until now.
Still waiting.

So, he is thinking of leaving Canada in Dec and apply for clg from India for May intake.

Therefore, the question is, Since he got study permit visa until 2020, would he face any problem in applying for another clg from India.

Any suggestions or advice would be greatly appreciated.

1. If he hasn't attend school since May and the school has reported him to IRCC, his Study permit would have been cancelled after 90 days.
2. He probably wouldn';t be issued another study permit, as he obviously been studying.

Why he wants to apply from India? And why he could not get admission into any college in ontario? its better to stay here and apply in Canada

He already has his application pending offer letter approval in some college. Would his study permit still be cancelled after 90 days from Sep?

Once he's out of school for more than 90 days - his study permit is canceled. It has nothing to do with having an offer letter from another college. It's about whether he's attending school or not.

Yes he has taken a 3month course in some college just to keep himself enrolled in studies. Would his SP still get cancelled?

Hard to say. Did he change schools? Did he inform CIC that he has changed schools?

We asked lawyer before enrolling him in that college. He said he has to be studying something until he gets his offer letter or his SP will be cancelled, which is why he did that,

btw its his second month gong on in that college.

If he didn't inform CIC of the change his student visa may have been cancelled because the previous school would have reported him. You need to figure that out before he continues his studies in the winter.

Better he stays there and apply from there if he cant. Then adk him to contact good consultant whether in india or in canada to help him getting admission in good college or university. Doesnt matter where is he applying from.it wont b a wise decision to come back n reapply since he has already got the visa.
