Hello Everyone,

This is my first post and appreciate your help for answering my questions, I have read few posts and the members on this forum are very helpful.

I have my husband's surname on marriage certificate but not on any other document.

Even my passport does not show my husband's name.

I am the primary applicant for PR and we both have given IELTS and ECA done and EE profile created with CRS 465.

Now my problem is when ITA comes, I will have to give marriage certificate where the name differs from my profile name and other document details including passport.

So, should I get a new passport with spouse name on it and also change my surname so it matches marriage certificate?

Will CIC accept new name on passport or will I have to apply for the EE profile again. But my IELTS and ECA and other documents are in the current name.

Please help me.. I am very confused and don't know what to do.

Is marriage certificate mandatory to be submitted? Will something like affidavit not work?
 
I think since spouse is also in the application, some proof of marriage has to be shown and what best than marriage certificate.

But even that has my marriage name and not my maiden name. Planning to visit a lawyer and see if any affidavit can solve this problem.

Is it a good idea to get spouse name on passport before ITA and also get my name changed to marriage name?

I am unsure if u should change name on passport so I will let someone else answer u but I am confident you need one and the same person affidavit.

Hi.

We had the same issue, albeit I was the primary applicant and not my spouse. The Ielts and eca were on old name and old passport. We got the passports changed and got the medicals and pcc on the new passport with her married name. Enclosed a letter of explanation for the same and also in the profile we added her "have you been known by any other name" section.

I think there is a template available on this forum but I got a lawyer to create one from scratch.. I was charged $80 but was job 'well done'.



If and when you will declare that you have used another name on the pr application, another place holder will show up to upload evidence of name change....OTSP affidavit could be uploaded there

I hav a doubt. I am the primary applicant and my spouse surname on marriage certificate is different from that on his passport. He has a middle name included in his passport but not on any other documents like degree certificates and marriage certificate.
Please help.
Should we provide an affidavit?

We've requested our criminal/background check from back home and on her criminal check they automatically included her last name as my last name and in bracket they wrote ''Born >Her LastName<''. I think back in my country they automatically write your last name to the husband's last name once you get married.

When I did the application, they asked if she is using any other names, I said ''No''. Will there be an issue because of that?

Please advise.

Your marriage certificate will have her new name and back it up with a detailed LOE, explaining why the name was not changed in the passport

Thanks for the response. We got married in Toronto. She did not change her surname and also on our marriage certificate she still has her surname.

It's just on the PCC her surname is written as my surname and in bracket they wrote her surname before marriage.

Should I upload it like that and explain it on the LOE?

If the marriage certificate doesnt have your surname may be u have done it for a reason as she wants to keep her surname.
You have to mention the same in LOE.

I suggest you to chk with legalfalcon once
 
In PR profile, I have written my wife's name before our marriage but in new passport her name after marriage is written.

So if there any issue with this name difference?

How can I correct this mistake?

I have query on the similar line but kind of opposite in nature. My wife applied for passport after marriage so we used married name for the same. Now for PR process we need to get the marriage certificate. So I am wondering whether to use her maiden name in it or is it okay to have it with her maiden name( changing name seems to be long and tedious process in Bangalore).
 
Hi All,

I received ITA on January 10 this year and ready with almost all documents. I have my after marriage name in mostly all documents except my educational ones. And as a result system is asking me to provide "Proof of Name Change Document". My query here is that
1. If I provide my marriage certificate along with Letter of Explanation ...Will it be sufficient or

2. I need to provide notary with above mentioned docs...

To add to this point I am currently in USA and marriage certificate is issued from India. Even if I think of notary option, is it possible to make notary for Indian documents in USA
