Hello all! I'm applying for permanent residence for the first time. My common-law partner is a Canadian citizen, and we have been living together since I moved in 4 years ago. He has always lived in Canada. For the purpose of the PR application, I said he was not accompanying me, as he is a citizen who already lives here. Is this correct? I still have several weeks before I need to submit my application. Thank you!

Is your spouse sponsoring you? (And if not, why not?)

Because if so, it's simple - spouse is the sponsor.

My spouse is not sponsoring me. I'm applying under Express Entry, Canadian Experience Class. I thought this was different than having your spouse sponsor you.

We chose not to use the "common law marriage" track because the processing time and amount of proof required seemed very high.

You ARE declaring that your marital status is common-law, correct?

Up to you, I don't think it's htat high a bar.

Anyway: you include spouse on your personal history/addl family info form. NOT on the main IMM0008 form, because that is for applicants to become PRs, and a citizen or current PR is not eligible to apply.

You might include a short letter that your spouse is not on that form because already a citizen.

What is your CRS score? What has been your status in Canada for the past 4 years? You both should have been declaring your common law status for 3 years to CRA and the same home address for longer than that. Are you on a lease together or do one of you own your home? What about bills or shared expenses? You must have bills in either of your names dating back numerous years with the same address as well as proof of shared expenses. Assume you also have proof of being at various events and holidays together. should be relatively easy to prove common law status after 4 years of living together.
