I think that the question was if one can change the NOC category after the application has been returned due to cap is full, and the answer is yes you can change the NOC for EE if your FSW2014 was returned due to cap is full as CIC does not maintain any record if the application was returned due to cap is full

But you have to do it in EE as FSW in 2015 is part of EE

Sure he can, but IF the old application NOC (say, 2172 for years 2010-2012) is stored in the GCMS records, and later that person applies with say 2173 for those years - they WILL see the mismach of records, reject the case for misrepresentation, and ban the said person for 2 years from applying to any immigration streams.

If an application is returned due to Cap Being Full and the fees were not encashed, then CIC maintains no record whatsoever of such application.

It is possible that a person's job description matches with two or more NOCs.

So it is also possible, that h/she sends two apps for two nocs for the same job and duration. This can not be misrepresentation.

Specially in managerial roles, have you not seen positions such as, Manager/Head - Finance and Corporate Affairs, or Manager HR and Public Relations?

Hi,

Called CIC on February 23, 2015 and was told by a lady that my application was returned to me on January 15, 2015 although I have not received it yet. The reason was because my Job Description did not match the NOC. I am concerned as I KNOW it matched. She did not want to give me my UCI and when I asked her if my DD got encashed she said that C.I.C. "does not keep money for applications returned". I have been checking with my bank and up to Friday, February 20, 2015 it was still not encashed. Can someone give me an email address for C.I.C. that I can send my concerns to, or [/color]advise me on the next step? I am concerned that for the Express Entry System, only persons who have job offers may benefit...am I right? I have put my timeline below for reference:

NOC: 1212
Date Application Sent to C.I.C: November 28, 2014
Date Application Received by C.I.C: December 3, 2014
Mode of Payment: Demand Draft (DD)
