Hello Everyone,

Thanks for the advice in the end. I am just starting the process to be sponsored by my husband.

He starts a job in Canada in a couple of months and is a citizen. We have been married for 5 years.

The very end of the family sponsorship application requires you to provide proof of a relationship it notes that if you (1)are living together, (2) have children, (3) in your first marriage AND (5) been married for a minimum of 2 years that you don't need to provide additional proof of a legitimate relationship. My spouse and I do have all of those things but we had one daughter who died shortly after her birth. Should I still check yes to this? Do I also need to include her in the additional family section?

I'll try to answer in a way that isn't diminishing to your loss but it is a bit hard in text, so if it comes off negative in any way, sorry.

If you were to check "yes" and not include the additional proofs and IRCC then decided that your deceased daughter did not qualify as "having children", your app would be returned. I think that whether you check "yes" or "no", it would be better to include all of the additional proofs, along with a letter of explanation; that way, you cover your bases no matter what.

Yes, you should include her on IMM5406. For present address, you can put "Deceased". You should also include a copy of her death certificate.

I know this is a tough subject and I truly appreciate the reply. The thing is we made sure to get every piece of documentation for her. We have her birth certificate, death certificate and social security card.

My question was if I decide to click "yes" and provide that information, I'm wondering if the application will be returned because if I were to click "No" I would have to provide 20 photos from my wedding, and two other forms of proof that my husband and I have a legitimate marriage.

Checking "yes" and not including the additional proofs does have a bit of risk that your app would be returned, depending on how the officer interprets the "having children" condition; I don't think that it would be returned but you never can know how each individual person may think.

Honestly, I would check "no" and include all of the additional proofs and a letter of explanation. That way, you cover your bases and the app won't be returned for that reason.
