The police made an error on the first certificate they provided my partners with.it said he was convicted of theft (a Christmas wreath while drunk 7 years ago) cic requested court documents at which point it emerged he was never actually convicted the case was thrown out of court. The police provided a court record along with a certificate with out the theft conviction. My question is should he seldom the new certificate without the theft conviction on its own or with the record to show he was up in court but not convicted?

as long as your partner can prove to CIC that he was not convicted of a criminal act then he should be fine.
different countries have different procedures so i am not sure where he is from but if he can get a new police certificate not showing the theft conviction its great if he can't then the court document showing he was never convicted and the case was thrown out should work too,in both cases and for his best benefit a cover letter should be drafted along with the police certificate just to avoid any confusion a visa officer may encounter.
