Dear All,

Hope you are well.

I am planning to apply for Canada Immigration and though to do AFP police clearance (since i was in Australia for 5 years).

I was caught driving while my licence was suspended. I departed Australia in August 2012 and traffic fine came in Sept 2012 so i was unaware about the fine. I came to know about this from AFP clearance as court traffic fine is mentioned is it (may be it is outstanding ?) and it is of $400 and 9 months licence disqualification. I am ready to settle this fine and pay it off but i am worried if i pay this fine, will it be cleared from my PCC ? or will it be a problem if i apply for Canada immigration ?

I guess the first thing anyone here will ask is why in the first instance your licence was suspended before you were caught driving on a suspended licence. Was that initial suspension just a minor traffic offence such as speeding or some other minor infringement as opposed say to dangerous driving or DUI.
 
I’d suggest consulting legal council. Driving while suspended is a criminal offence in Canada, as are some speeding offences (reckless driving), so it would all depend on how the charges in Australia relate to Canadian law. If I understand correctly, if you pay the fine and the charges equate to a serious offence in Canada, you would be ineligible to enter Canada for at least 5 years from the date the charges are discharged (the date you pay the fine or complete the sentence). Others can correct me on that. Again, I’d definitely consult with a lawyer familiar with both Canadian immigration law and Canadian criminal law on the subject.

Thank you for your reply. I am financially not in position to hire immigration lawyer. I yet to pay this outstanding fine and financially i am not well to pay to immigration lawyer. i am sure they charge heaps.
 
See if you can get a free consultation out of one. At least it will give you an idea where you stand.
