Confusion in the LMIA ADVERTISEMENT REQUIREMENT

Hi there, I've searched through this forum and also on ESDC.ca but there is conflicting requirement listed under advertisement requirement.

The advertisement must be posted for a minimum of 4 consecutive weeks starting from the first day the ad appears and is accessible to the general public.
The advertisement must be posted during the 3 months prior to the employer applying for an LMIA.

So do I have to have the advertisement up for 4 weeks before applying for LMIA or 3 months..??

The advertisement must be posted for at least 4 weeks, and those 4 weeks must fall within the 3 previous months from when the application is submitted.

So let's say the advertisement is put up on April 1st. It means it can't be taken down before April 30. (My two cents are that it should stay up for more than just the minimal requirement - the employer must show that they've made real efforts to try and hire a Canadian for the job first, so just doing the barest minimum may not make the best impression.)

The 3-month requirement means that the 4 advertising weeks must be done no more than 3 months before the LMIA application is sent out. So again, if the advertisement starts on April 1st, then the application must be submitted no later than June 30. It's just to show that the advertising is still considered relevant for that particular application.

LMOs no longer exist. LMIAs replaced LMOs.
