Hi everyone,

I got an email from MVO today and it left me a bit confused. My partner has two DUIs on her Korean CRC but they are both under the legal limit in Canada. The email I received today specifically asked for "your own explanation of the circumstances"... but I thought we already did that.

We received an email about two months ago asking us to send any additional documents we may have omitted when we submitted our package. At that time I sent a copy of the Korean laws that were broken, translated into English and a written explanation of what happened for both DUIs. I'm confused about this because we sent the written explanation and I believe it covers everything that they asked for. The only things I can think of is that a) we should have separated each explanation b) they want more detail (not sure what kind) c) perhaps we mislabelled the file - I sent it as "Addendum to Criminal Record Check", it was the two explanations in one PDF and included a brief description in the body of the email.

Can anyone shed some light on this for us? I'd like to do it correctly ASAP but I'm not sure what exactly we've done wrong. I've quoted what we sent them and the email below. Please help!

As noted on form IMM5669 #6b I have two DUIs from over five years ago. Both times my blood alcohol level was below the legal limit in Canada (0.08%) and I was required to pay a fine. I have written about both incidents in further detail below. I have also attached a copy of the Korean laws I was fined under, which have already been officially translated into English by the Korean government.

My first DUI occurred on January 18, 2009. I met a friend in (district) in (city). We each drank a two glasses of beers (one glass =500cc ) at the bar from approximately 8pm to 11:00pm. After leaving the bar, my friend couldn't get a taxi easily and we thought that because we didn't drink very much and after bar we stayed out side while for keep talking I was okay to drive. I was pulled over by the police after I drove 4.52 km (on street) from the bar. They tested my blood alcohol level with a breathalyzer and I passed safely so the police officer let me continue on. I dropped off my friend at her home and started to return to my home.

However, when I was going home from her house, I met another police officer in (district), (city) at around 12:03am and got tested again. This time the result was 0.074%. I told the police officer that I had just been tested a short time earlier and that I had passed but the police officer said we should go to the hospital to do a more detailed blood check. I thought this situation was unfair but I had drank two glasses of beer and I was afraid of making the problem bigger. As a result, I went to the police officer’s car, got a ticket, and then I went home by taxi.

Later, I received the ticket information in the mail. I received a fine of 1,000,000 KRW (approximately 1,500 CAD) which I then paid at the local bank. My license would also be suspended and I had two options: a) 100 days suspended or b) 50 days suspended but I was required to take two driving classes, one from the Road Traffic Authority and one from a police officer about drunk driving. I chose option b and took the two classes, paid the fine in full, and my license only suspended for 50 days.

My second DUI occurred on April 8, 2011. I met my friends for dinner at an eel restaurant in (district), (city). We were at the restaurant from approximately 8pm – 10:30pm. During this time I drank two glasses of beer (one glass = 200cc) with my dinner. I left the restaurant to return home and decided to drive because I hadn’t drank much and the restaurant was only 1.20 km away from my house. After I drove 150m from the restaurant I met police officers at around 10:48pm. They tested me with a breathalyzer and my result was 0.059%. I got a ticket from them and came home by taxi.

On June 21, 2011 I received the court information in the mail. I received a fine of 1,500,000 KRW (approximately 1,500 CAD) which I then later paid at the local bank. This time I was given the same choice as mentioned above regarding my license suspension. I chose to take the two classes and so my license was suspended for 50 days once again.

perhaps they didn't receive it when it was sent or it wasn't filed correctly? i'd recommend responding to this request with the information again, noting the date it was initially sent. i would also recommend sending it more than 1 way (even though they may not like that). By email, CSE, fax and/or courier. If you send it at least 2 ways, you know they will get it. also, double check the police clearance (if you have a copy) to make sure there isn't something that you're missing in your explanation and the dates/times/locations match up.
 
Thanks for your response. It's a bit puzzling because I sent another document in the same e-mail and they didn't request it again so I figured I'd made some kind of mistake.

I'll definitely double check the details one more time and make sure everything is correct. I could've made a mistake or typo. Does it seem as though enough information was given? I'm going to use more names and include the name of the friends involved and police officers. I can't think of what else they could want :/
 
Just getting ready to re-submit the documents. Anyone have any other insight or had a similar experience? Any opinions would be welcome :)
