my Wife and I just got married last month, and i was in the process of filling up the form when i realized our situation is kind of different, just wanted to verify first.

My wife is Filipina, but is currently in Kuwait under contract til January, 2013.
Will her papers be sent to the Philippine Embassy in Kuwait? Or will it still be sent to Manila?
our marriage met all requirements under the Kuwait Law so thats not a problem.
also we haven't had her name changed yet on her passport, should i get that done before i start to process?
Because as we all know Middle east countries hold your passport and other papers <-- issue??

Also if we were to have her last name changed how would i fill up the Portion that asks family name(s)
with her maiden name and new last name?


when she has to go to the embassy for the interview or so forth will that also still be in Kuwait? (because her company won't let her leave the country til her contract is over)

Persons who are resident in the Kingdom have their applications processed through the Canadian embassy in Abu Dhabi. This is because there are specific exit requirements for that region, and Abu Dhabi handles all of that in their processing (as you noted, her passport and other documents are held in someone else's possession).

You can get the name change done before or during processing. If you do it during processing, send a copy of the new passport's bio-data page to the embassy. If you do it before, you fill out whatever name is in the new passport, there is a space for married women who have had a name change to indicate their maiden names.

Any interviews would be conducted by Abu Dhabi. An interview is an exception, not the rule.

Abu Dhabi's current average processing time is 26 months.

would you recommend i wait til her contract is done and pick her up bring her on a tourist visa and apply for the permanent residency in-land?

The problem with that plan is that there's no guarantee the visit visa will be approved. In fact, there's a significant chance it will be refused. To qualify for a visit visa, you must prove you only plan to come to Canada for a short period of time, have strong ties to your home country and have no plans to remain long term. It's going to be difficult for your wife to prove this given she has a Canadian spouse and there's a good chance CIC will suspect she wants to stay for longer than a visit.

There's definitely still a chance she might be approved. But don't assume she will be.
 
Another option would be to wait until she's back in the Philippines and apply through Manila. Manila has far shorter processing times. But again, that means waiting since it sounds like she won't be back until January.

yeah sounds right, So tourist visa is out of the question. dont want to have a bad mark on her record.

I did read though in an abu dhabi thread that lately they have been going about it pretty quick, but 80% of them are still getting no response after a year and finishing up after 26 months.

What should i do? should we take the risk and apply right now? or hold off for 6-7 months?

Realizing how hard this must be for everyone to be apart from their loved one for so long. :'(

If it were me. i would apply through Manila. ive been reading through the threads and some of them are processing very quickly! you could spend this time gathering information and making sure when you do apply the application is 100 percent done and nothing is mistaken.
and apply through manila and i think it will be alot faster.
But thats just my thoughts :)

if abu dhabi is processing quickly too. i would suggest if you want to apply through there, to make sure your application is really good so you have a good chance of being one of the lucky people that get processed quickly! :) only problem is after your spouses work contract is up. and you apply through abu dhabi, you will still have to send everything to that Visa Office. and if by a slim chance you get called for an interview it will have to be in abu dhabi.
just some things to consider

anyways i hope your process goes through smoothly and quickly! :)
 
would a TVR be hard to qualify for in our situation? she does intend on enrolling for a vocational course, though still comes down to - its obvious i don't plan on having her leave.

i wish i knew more about all of this, ive done about 5hrs a day of searching and reading on the cic for the past 2 weeks.
 
I think it will be fairly difficult. She has a Canadian spouse. She has low/no ties to the Philippines because she's been working outside of the country for some time. She's only in Kuwait temporarily (i.e. has low/no ties to this country too). I also believe Philippines nationals have a fairly high refusal rate. Again, no harm in trying (won't harm the PR application if you're denied). But definitely have a plan B in mind.
 
Note that if she plans on attending school for more than six months, she'll need a study visa rather than a TRV.

Looks like its either apply in Manila, or Abu Dhabi.

if only it were valid to say "we opted TRV, because my wife doesn't want to move, im just trying to convice her" lol. over come a lot of obstacles already with the marriage alone due to her religion, seems like every time i knock something down something else gets put back up.
