Hello Members, I came to Canada in 2018 I was given a hearing date later the date was changed and they informed me they would let me know, I never heard from immigration until i changed lawyer in 2022 , After the hearing the officer did not give a decision and requested for doctors report , After doctors report was submitted , Last week my lawyer informed me the officer in charge was not available anymore that i have two options its either i apply for a new hearing to be heard by a new officer or let a new officer decide on the documents submitted already. I would like to know does this type of situation happen most times ?

I would question your lawyer's integrity given the first advise....2018 today is almost 5years waiting for hearing, let aside if you still have work permit. You need good lawyer

What have you been doing for 4-5 years? Did you not follow-up about your case? Had you been able to keep renewing your WP without question? This is an incredibly rare situation. It really depends on whether you think you have provided enough proof for approval with the documents you have already provided, the doctor’s report and the notes from your first hearing. If you think that the member needs to be able to ask you questions about your need for asylum to get a sense of your case then would ask for a new hearing. Your lawyer should have provided their recommendation.
