complecated situation.

we married in feb 2015 in Korea, wife moved to BC in dec 2015, got pr in May 2016.
we have developed alot of differences and have decided to separate. (their is not appetite to work things out anymore from both parties)

now, as per divorce in BC guidelines, if we live together for 2 years after marriage, i will have to pay spousal support/share property etc. etc (which i don't want to do). also i wish that she would retain her PR status. but we are yet to hit the 1 year mark since she received her PC (as corp 51 is an issue).

not sure what we can do at this point. if i do get a divorce in coming months, how would CIC know about divorce and will they take away her PR status?

we are at a point that we can't live together anymore, i have offered her to pay her rent for when she moves out (next few months), and also her schooling. any way we can satisfy both parties.

I that is why this law is in place for this kind of situations....CIC will know if you get divorce for sure donot think they wont...

I am saddened to hear your story. My heart goes out to you.

The CIC can find out through a multitude of ways that you have split up -- notwithstanding required ID address changes, etc. You will likely require a divorce lawyer, unless the divorce is uncontested. Though, you've stated you don't want to split the assets that she is legally entitled to, so my guess is, you will in the end require a divorce lawyer, whether you want it or not. That person should be versed in how to manage the CIC problem, if you wish her to keep her PR (and you'd ultimately be required to repay social assistance, on top of the alimony, if so sought and unreported).

There is several stories of inland CIC catching wind of couples under Cond 51 that split, and they demand a same-day home inspection. One case I read about actually jailed the woman (PR) on the spot.

You might be better to wait for it's repeal (no one can say when this will be), or to work something out with her, so she can remain living at the matrimonial home.
