I am going to send a complaint letter to CIC etobicoke. Please share your views about this and correct my letter if its wrong. Thanks

Dear Sir or Madam,
My name is xxx xxx xxx and I am sponsoring my wife xxx xxx xxx. My client number is xxxx-xxxx, my wife’s client number is xxxx-xxxx. My sponsorship application number is: F0000xxxxx.

I submit my sponsorship application on September 19th, 2011 and now, almost two years later still waiting decision for Approval in Principal.
According your web site approval period varies between six and ten months for AIP and eight to twelve months for PR status of sponsored person.
I would like to know what is wrong with my application and why you are treating me as a second hand person. I am Permanent Resident of Canada, who pays taxes every year and I think I deserve to know what is wrong with me and my wife and our application.
As a future Electoral voter February this year I have been to the Etobicoke’s MP Ted Opitz office. I understand from his office my application has been transferred from Vegreville to Etobicoke. Nobody from CIC inform us for this transfer.
Me and wife living under huge stress and depression from the unknown situation. We feel like we are isolated from the rest of the world. Even we didn’t go to a real honeymoon yet.
Because of the long waiting time I have been calling CIC Call centre many times to ask what is going on. And I have been advised to order ATIP notes of my file.
I received those notes couple a days ago and I believe you have some concerns about my relationship with my wife xxxxxxx and concerns about age difference between us.

In fact this is your job to be suspicious but I will be very happy to prove you are wrong. Me and my wife are ready to assist you getting a decision soon. We are real persons and real family and we have rights.

Hope you are going to make a decision as soon as possible.

I understand your frustration, but you have to remember, they will take longer to process applications with lots of red flags.

In your case, your wife is 17 years younger than you, she filed a refugee claim in Canada and was refused, then issued a deportation order, and 2 months after filing her refugee claim, she met you, and you guys got married THREE months later.

If you had a relatively straight forward case, where you guys dated for years, you guys were almost similar in age (give or take a few years), married, no refugee claims, etc, then you have every right to demand an answer, but your case is way more complex. You need to see things from CIC's point of view.

Maybe you are right, but I am with this girl more than two years and I feel stupid to explain something that is really true. I am sure there is a lot of scam marriages here in this forum with positive decisions, but when I feel I am right and 100 % my marriage is real I am free to complain every minute. And every cic officer who is not believe my marriage is true is invited to my bed, just have to bring some lube...

Her refugee claim has been refused one month ago, and we got married 30 months ago.

I support your efforts to get action. If they have concerns about the legitimacy of the relationship tell them to either approve it or deny it now so at least you can proceed to the appeals process.

You don't need to share her. Just take pictures of your little soiree and send them out to CIC the next morning.

I don't think writing a letter like this is going to change anything.

You should:

- periodically ask for your GCMS notes to know what is going on with your file
- ask your MP to inquire on your behalf as to an approximate estimate of how much longer it will take.
- after that time has been exceeded, or if it is excessive, ask a lawyer if it would be a good idea to file a lawsuit asking for a "writ of mandamus" - this forces the government to make a decision within a specified time.

I don't think anybody should be subjected to these kinds of processing delays. It should be up to CIC to see it from the point of view of a couple who have a legal right to live together in Canada, not the other way round.

But is there a right of appeal in this case? This is inland application. I don't think there is.

I will try. It is disgusting to prove love and family when it is real. Even I didn't hire a lawyer because I believe when something is true IT IS TRUE

I ask a lawyer about "writ of mandamus" but he told me it going to another two years for the superior court to take decision

Maybe. You probably need to time it so that when the court hears your case, CIC will already have taken too long.

Sometimes court action can get CIC's attention, so ask your lawyer again in a few months and follow his advice.

The only on reason to complaint is because we can not travel. We are stuck in Canada two years. And we don't want to stay nailed for another two. I am PR and I can travel, but I don't want to travel alone without my wife. If there is a way for to travel outside and then go back here, we can wait 10 years. That's it.
