Hello All,

One of my family friend, who has a niece came to Canada as a visa student.
Now her niece got really ill with her eyes problem which reduce her vision almost to blindness. Will her niece be able to apply to stay in Canada under compassionate ground because of her illness?

Please help. Thank you in advance.
 
Others can comment as this only a personal view but would think it unlikely she could stay on the basis of illness given she would be expected to return home especially if she has family in her home country. Add to that any possible future demand on Canada’s health system.

I'm very sorry to hear about her condition.

The only option would be to apply for PR under H&C. H&C applications have low approval rates and unfortunately this case is unlikely to be approved. Having said that, if she wants to try applying - the best option would be to consult with a good immigration lawyer to find out her chances of succeeding and to assist with submitting the application. Processing times for H&C applications are around 2 years. Note that it typically takes at least a year for first stage approval - sometimes a year and a half - and applicants have no access to provincial health care coverage during this wait time. This means that for the first year to year and a half, she would have to pay for all medical expenses out of her own pocket.
