Common partner visa question, please help if you can

I recently got my PR and moving to Canada soon; my girlfriend is in the US and she'll be completing her studies mid next year and I would like her to come and live with me in Canada. I've read about common partner visa but not sure how to file everything. Do I need a lawyer or can I file everything the same way I did for my EE.

We've been together for 4.5yrs and living together in the US for 3yrs+ and we have a leased car together, joint bank accounts, house-lease agreement together(I have proof). Do I need anything else? Also funds and other documents I may need? I would like to make a list of things and get everything ready so by the time she graduates she can come over. She also has a 9.0 IELTS and BS degree in biology.

Im a bit tensed since I don't know the visa category well. Hope someone can share their experience or show the right path to take. I know this is the best place for that

Have you mentioned "Common-law" as your marital status in the current PR application?

No I got my PR 5months ago but it had single never married, divorced, married and widowed

Do you know the exact visa category that I should apply for ? I'm a bit confused as it says "sponsorship visa for spouse is asking for me to be in Canada for 5years"

Also the common-law partner visa is saying that she should be in the country.

I'm not sure which visa I should be applying for. It would be great if she can work. If not she can come over and stay every months on her tourist visa but that's just going to waste her time. She's graduating and currently working in a hospital as an intern. So she wants to have a career in Canada. Worst case scenario is working full time from may2016 to May 2017 and filling for EE. But that's a long time to wait and not sure if EE would be around by that time

Not sure why you did not get common-law option. Maybe it pulled this data directly from your come to canada tool entries. The reason I asked this is because, I believe you need to mention information about your spouse/common law partners if you wish to bring them to canada or sponsor them later. Irrespective of whether they will be accompanying you or not.

In your case you were in a common-law relationship while you applied for PR as single applicant. Now when you try to sponsor your partner you will be contradicting the information that you provided earlier.

This is my take on your situation. Lets see what other forum members have to share.

Your common-law partner needed to be included in your PR app. If you didn't declare her and she wasn't medically examined, she is forever excluded from the Family Class and cannot be sponsored. She will need to immigrate to Canada on her own merits.

I completely understand your point
I was not thinking properly but I honestly don't remember a common law partner option but I could be wrong. Thanks again for all your help
