Hello,
I was just wondering if you can apply for PR under common law if you have lived together for one year , are still in a relationship but no longer live together .

Hi

Yes. Once you have established common-law status, you remain common-law even if you are no longer living together. You will need to be able to show that the relationship is ongoing even though you are apart.

You need to have a read of the actual CIC spousal sponsorship checklist for common law applicants (IMM5589), Item 7 on the last page. There it describes the evidence you need to supply to demonstrate common law for the purposes of CIC immigration.

Select 'I am sponsoring my common law partner' in the first drop list.
Select the country that the sponsored person is currently living in in the second drop list.
Hit the 'Get checklist and forms' blue button.

It isn't a specific thing, or step, like a wedding. You have established common law union when you have lived together for 12 months or more as a couple. This can then be demonstrated/proven in a variety of ways, as shown above.
