You are a common-law partner—either of the opposite sex or same sex—if:

you have been living together in a conjugal relationship for at least one year in a continuous 12-month period that was not interrupted. (You are allowed short absences for business travel or family reasons, however.)
You will need proof that you and your common-law partner have combined your affairs and set up a household together. This can be in the form of:

joint bank accounts or credit cards
joint ownership of a home
joint residential leases
joint rental receipts
joint utilities (electricity, gas, telephone)
joint management of household expenses
proof of joint purchases, especially for household items or
mail addressed to either person or both people at the same address.

We have basically lived together for this past year with absences of nine or ten days ( or less) interspersed through out but no longer than that. We are applying for a joint bank account as we speak. We're on record as each others emergency contacts in several places (our jobs, MedicAlert, hospital records). Several pictures of us together plus I was allowed to attend certain formal dinners that only individuals and their spouses could attend. So basically, I am his wife in every way but on paper :p ;)
We call each other husband/wife/partner and our friends and families treat us as such. He's trying to get me on his insurance policy at work as well. They said they'd cover me or so my boyfriend said. The big problem is that we don't have a joint address or bills as he lives with his folks so he doesn't pay utilities or anything like that. But his folks can vouch that we have lived together for this past year. We have several people that can vouch for the validity of our relationship. Even the Customs officer the last time we went into the States said we should just get a visa after the amount of visits and stays. I know I'm grasping at straws here but I really want go 'home' and be with the love of my life.

It sounds good to me, you need to get his folks to write a letter or provide proof that you were living there together for the past year.

yes it does sound like you have lots of information. I agree with the letter from his parents. as far as adding you on his insurance at work, won't happen till you are eligible for Provincial healthcare, have been thru this with my husbands insurance and to be covered by secondary insurance provided by employers you must first retain a provincial health card. he can however add you as his beneficiary on life insurance policies and add you to homeowners insurance and auto insurance, if you been living here for a year you should have switched you license over well depending which province your in. some provinces you can't but others require you to do so with-in 3 months...

OMG!!! :D ;D :D ;D ;D :D Am grinning ear to ear here. We are going shopping for house stuff soon. Which only solidfifies our case. Can't wait to tell my boyfriend. Yes, he does get life insurance through his work too. But maybe we can get a seperate policy to help a case.
We'll go that route as common-law. Fingers crossed. I'll get to stay with my love soon. Really hope this works. This is the best news I've got so far.
I'm also staying through the winter too, through the six months allowance. Could I do so and file in Canada or do I have to return to the states first? No biggie, just trying to limit my crossings at this time as I do not want to look as if I'm working the system.

Nice. Ok I'm doing the paperwork. ;D I'll start work on the insurance/Medicare application and such. I haven't done it as I was unaware that I could apply. My boyfriend wasn't either as he's never dated a non-Canadian.

I spoke to my love again ( visiting for a bit to finish out my job) we are opening a joint account in a few days time and I have the paperwork of common-law sponsorship (spooky :eek: :D) . This next chapter of our lives should be interesting. Fingers crossed. I'll keep you posted. Hone is where the heart is so I can't wait to go home for good.
