My Chinese girlfriend and I have lived together for a total of 13months. However because I need a Visa to live in China that 13months was not continuous. I would like to know if we still qualify as common law?

The time spent living together is split in two parts. The first is from September 18th, 2007 to July 30th, 2008. Then October 28th 2009 to January 26th 2010.
 
I believe it saysyou must live together for one contiuous year.But like i said before apply explain the gap and hope for the best the worse than can say is no.
 
From the Sponsor's Guide

"his last category is intended for partners of Canadian sponsors who would ordinarily apply as
• common-law partners but cannot meet the definition, that is were not able to live together
continuously for one year with their sponsor, or
• spouses, but marriage to their sponsor is usually not an available option to them,
usually because of marital status or sexual orientation, combined with an immigration barrier
(for example, rules preventing partner and sponsor of long stays in one another’s countries)."

Would I fall under this category?
 
No as you are not same sex but the other where it says rules so if you were not allowed to stay for a full year because of the visa then yes the second would apply
