Common law start date and dates of proof

Hola,

My partner and I started dating April 2011 and he moved in to my flat August 2011.

When completing the common law form, when do I say my common law start date would be? I'm assuming August 2012.

As back up evidence, do I provide proof of common law August 2011-August 2012 or after August 2012?

Hi

You became common-law August 2012, one year after you started living together. You want to provide proof starting from the day you moved in together up to present (assuming you still live together).

In the case where evidence from aug 2011- aug 2012 is scarce, I'm assuming that as I can provide solid evidence from mid 2012 until today is not going to be an issue?

State the correct date you started living together, then provide the solid evidence from your slightly later date - in any event, you 'solid evidence date' still shows you living together for more than one year, so that's fine.

Tell the truth even if you do not have solid evidence to back it up, you can prove at least one year so no problem

Brilliant, thank you.

Out of 5 shared address since 2011 I still have copies of 3 leases as well as joint bills, bills to he same address's, joint booked flights, for 3 months of travel we have flights and country stamps of same day entries... Reckon I have enough proof :p

Not an issue at all. As long as you have proof covering any one year time period, it's fine.

I'm guessing, for instance, a signed lease starting on July 1st 2012 and then a letter or bill for the same address 1st July 2013 kinda thing?

You need continuous proof from throughout the year, not just something from the beginning and the end.

Are you saying we need monthly bills etc for an entire year? This could be difficult.

You don't need monthly bills but you need proofs throughout the year. A lease at the beginning of the one year and a piece of mail at the end doesn't show that you were both living there continuously.

I only ask as our entire relationship has been punctuated by months of travelling and although our relationship is in no way fabricated, I just want to be clear on what cic expects to see. At the very least I can print 6 years of Facebook as cic mention social media as proof of a 'public' relationship.

Does the 12-month living together continuously have to be immediately prior to submitting a common-law application? My daughter has been living with her partner for 2 years, but he has to return to his home country for a while, maybe 4 months, (she will remain in Canada to work). No PR application has been submitted yet. Will this separation affect their common-law status?

Doesn't have to be immediately before, just prove it was driving at least 12 months :)
