Hello there,

Does anyone know about family class sponsorship of the common law type or has gone through the process? Is it as easily processed as a spousal application would be?

My partner and I have been together since 2012 and had our first son in 2014. He is currently going through a divorce process which has been going on for 1 year. It is completely legal for us to be living together and having children we just cannot get married as it is against the law until the divorce is final. It can take up to 5 years for a divorce to be approved and we just don't have that much time to wait.

If anyone has any suggestions it would be greatly appreciated as we are just stuck with no knowledge of where to turn for help..

Oh and just for a note I am a Canadian citizen, our son is a Canadian citizen and my partner is an Indian citizen.
 
You can apply now provided you have lived together for a minimum of one continuous year together - and have the evidence to prove this cohabitation (e.g. shared leases, etc.). You don't have to wait for the divorce to come through.
 
Read this: How can my common-law partner and I prove we have been together for 12 months?. Please note that CIC does not require ALL items on that list.

The country-specific applicant guide should also have a section for Proof of Relationship to Sponsor that will give you additional things that are required or optional. Read carefully and Google any phrases that seem unclear for a better understanding.

The more significant and documentary evidence you have for EACH of the 12 continuous months of cohabitation, the easier it is for CIC to believe your relationship to be genuine.

If there are legal barriers for your getting married, I suggest that you also include an explanation of that. And if you have plans for getting married after your partner's divorced is finalized, you can mention that as well (I think it's in one of the forms that the applicant fills out).
