Yes Rob you are correct unfortunately they were just short of one year

They were short by 4 days not 1 year. However they now need to start all over for a full 365 days.

But another question, if we live together for 6 months in our apartment in Mexico and then live together for 6 months at my parent's house in Canada (and he gets a Canadian Visitor Visa to do so) and then we move back to our place in Mexico..thus over 365 days... would that then count as common-law? or do we have to live in only one country for the whole year? Thanks!

That's fine. As long as time living together is continuous over 365 days, it can be in multiple addresses or countries.

Of course the easier way, is just to get married and apply!
