Hello,

I have a question about common law – PR process. I have lived with my boyfriend (who is PR) at the same address in Canada for 1 year. We want apply for common law and then for PR for me. The issue is, that I am leaving Canada in November (I will be on extension at this point) for next 6 months. Then I would like to come back and start to work again. The best would be get the work permit before I leave Canada. There are 2 months left. If I have common law paper and other documents showing we have lived together for 1 year, can I come to a border and ask for open work permit for me?

In case, we are not allowed to go to a border and we have to send all the documents to immigration and wait a few months to get an open work permit, can I leave Canada and stay in another country until I receive a work permit?

Thank you.

You must be in canada if applying for your open work permit and inland

Agreed with the above. You cannot apply for an open work permit connected to an inland sponsorship application at the border. You can only apply by mail and the OWP application must be included with the inland sponsorship application. Applying inland requires you to be living in Canada.

If you need to leave Canada for more than 2-3 weeks, then apply outland and forget about the open work permit. Or apply inland once you have return to Canada from your trip.
