Hi All,

I was wondering if anyone had any thoughts on this......

My girlfriend in Canada is sponsoring me as a common law partner, Outland application to the UK. We sent our application in mid September & this week have had returned, annoyingly.....

The reason given is that she did not include an NOA (notice of assessment) or proof of income statement.

We were unaware this was a requirement, as we ticked the secound box on the checklist (section 5) to indicate she is not working in Canada, (she is currently in her final year of nursing school in Alberta)
We provided all other documentation including a detailed financial plan of how we would support ourselves ie including bank statements, financial commitment from her parents, my previous employment history in Canada IEC and so on.

So... my question is, Are you required to provide a notice of assessment regardless of whether the sponsor is employed or not? Have CIC just made a mistake and looked at the wrong boxes or not at our plan of how we will support ourselves? Or is this there way of saying our financial plan is inadequate?

I would be interested to hear anyone’s thoughts on this that could help as we are now unsure of what to do and don’t particularly want to wait another two months to have our application returned again.

even if she is not working did she not file any taxes in the previous year? Students still file a tax return.
 
Yes that’s right and she did file a tax return, we were just not aware that this was required when submitting the application as she is not working.....

Then the answer to your questions is yes, the notice of assessment is required. They did not make a mistake and your application was correctly returned.
 
Anytime you do not include one of the requested documents you need to provide an explanation as to why. Never assume the obvious.

Hello, I am about to submit my application under common-law sponsorship. Regarding the NOA, my partner (Canadian born) did submit his tax return forms but he submitted it so late he hasn't gotten his NOA yet. We said so in our cover letter and we also include all of the tax return forms in our application. Would that be acceptable? - Thank you!

surprised he does not have 2016. Yes that is all you can do. When you get his noa you can add it to the application later.

Thanks - He submitted his tax return form quite late, in late January to be exact. Last time we checked, about a week ago, there wasn't a NOA for him available. We will definitely add it to the application when it's available.

I was in a similar situation last year..

It ended up that i did submit my PR app with my partners NOA but when it looked like we wouldnt have it i had taken screenshots of his online CRA account etc to show we were waiting for it and planned to include them along with a letter of explanation.

@WeegieInOttawa - thank you for sharing. That's a good idea! But in his CRA account it didn't say "we received your tax return/ are processing it", or saying "your NOA of 2016 is not available at the moment". It only says the NOA of this year and that year are available. Was that what you screenshot captured before?
