Hi All,

I need immediate help, I am on Closed Work Permit (Employer specific) since May, 2019 and my WP and VISA are valid till May, 2021, but my company is sending me back to India because as a part of cost cutting our client wants the Team in India, and I am not comfortable in going back to India during this pandemic. I have few queries related to the same -
  1. Will my status become illegal if I resign from my company as I have employer specific WP?
  2. Can I get open WP after resigning?

1. No, you won't be illegal. You can remain in Canada legally until the expiry of your work permit.
2. You don't qualify for an open work permit based on resigning. Open work permits are only issued in very specific circumstances. Have you applied for PR? (example: have you received ITA through Express Entry and submitted your complete application?)

In that case you can certainly quit your job and remain in Canada. However you don't qualify for an open work permit.

Can I apply for WP if I get an offer from some other employer?

You need a job offer and also an approved LMIA from the employer. If you can get the job offer + approved LMIA, then you can apply for a new closed work permit tied to your new employer.
