Hi all,

My friend is on a closed work permit with condition- not authorized to work in any location other than stated (Edmonton). Her husband resides in Ontario and is a PR.

Due to covid her client locations were closed and she was working remotely from Ontario for about six months. Her employer got to know she was working outside of Edmonton remotely (in Ontario) and is threatening of serious implications. She has also submitted a spousal PR application.

1. How will this remote work outside of province impact her?
2. Would this impact her immigration in any way or would the employer and/or IRCC make a big deal of this?

1. Generally speaking, most employers have code of conduct rules that require employees to get approval to move out of province for remote work. There can be many reasons why remote work in a different province may not be possible and/or requires approval from the employer. Employees should never relocate to different provinces to work remotely without first getting approval from the employer. So from an employment perspective, this may be a code of conduct violation which could potentially lead to termination with cause.
2. This won't impact the spousal sponsorship application.

Answer to question # 1
They could terminate her. More than likely there is a clause in her code of conduct in regards to working in another location , and that management has to authorize this . The employee cannot arbitrarily pack up and move and continue to work .
Was not a wise thing to do .
Cannot forget her work permit states it as well .

To apply inland sponsorship you need to be living in the same location. Even if the work was temporarily remote you still needed to adhere to the location on your WP. If it was possible to work from anywhere there wouldn’t be a need for a WP to work in Canada. Assume IRCC will likely overlook it if remote work is temporary and due to Covid but employer may not overlook it.
