My husband got arrested for selling alcohol to a minor while working in a gas station in US. He found guilty and got the Class B Misdemeanor. This was about a year ago. We are F1 student here and both are eligible to become principal applicant. Do you think we should apply with his criminal record? and who should be the principal applicant?

From my understanding of the process you need a current dated police clearance- whatever has happened in the past should not matter, as long as you are clear today of all charges. maybe if your record is all clear it would be better to apply as the principal applicant, but your husbands certificate will still be required nevertheless. Also there is a column in one of the application forms where you have to specify if you have ever been charged (by law) or not, so you will have to mention it there in your husbands application form.

Please read the link below to understand CIC's take on Inadmissibility. If the crime committed outside Canada has its equivalence in Canada then I believe the punishment is 10yrs or more imprisonment.

You can try for PR, be honest in all your declaration and hope for the best. The FBI record for your spouse will indicate the arrest anyways....so just be honest when you apply.
